These terms are the agreement between you and VivantFlow LLC when you use our apps:
- Vivant, our vocabulary app for iPhone and the web;
- Moien Lux, our Luxembourgish pronunciation app for iPhone.
Our Privacy Policy explains how we handle your personal data. It is a separate document, not part of these terms.
The short version
- Both apps are free at the moment.
- What you create in the apps stays yours.
- AI features can make mistakes. Use them as a learning aid, not as an authority.
- Moien Lux is not connected with the official Sproochentest and can't promise you'll pass it.
- If you live in the EU or UK, you keep every right your local consumer law gives you, whatever these terms say.
1. Who we are
The apps are provided by VivantFlow LLC, a company registered in Delaware, USA ("we", "us"). You can contact us at support@vivantflow.com, or by post at VivantFlow LLC, 8 The Green #17742, Dover, DE 19901, United States.
By creating a Vivant account, or by using Moien Lux, you agree to these terms. If you don't agree, please don't use the apps.
2. The apps
Vivant helps you build vocabulary in French and Spanish. It offers spaced-repetition review, a personal collection of words and phrases, AI chat, photo scanning, word explanations, pronunciation checks and audio.
Moien Lux helps you practise Luxembourgish pronunciation by comparing your recordings with native speakers. It has no account, and your recordings stay on your iPhone.
Both apps are free at the moment. We work to keep them running and useful, but we may add, change or remove features over time. If we stop offering Vivant altogether, we'll give you at least 30 days' notice and a way to export your words.
3. Who can use the apps
You must be at least 18 to create a Vivant account. Moien Lux is designed for adults; if you're under 18, you need a parent's or guardian's permission to use it.
4. Your Vivant account
- Use a real email address you can access, and keep your password to yourself.
- Your account is for you alone. Please don't share it or sell access to it.
- If you think someone else has used your account, tell us at support@vivantflow.com straight away.
- You can delete your account at any time in the app. Deleting it removes your words, history and chat messages, as described in our Privacy Policy.
5. Using the apps fairly
Please don't:
- use the apps for anything illegal, or to harass, threaten or harm anyone;
- use the AI features to create content that is hateful, sexually explicit, or that infringes someone else's rights;
- scrape, copy or extract the apps' content in bulk, or use automated tools to access them;
- try to get around security, usage limits or access controls, or disrupt the service;
- reverse-engineer the apps, except where the law allows you to.
6. Your content
The words, notes, messages and recordings you create in the apps belong to you. For Vivant, you give us permission to store and process them only so we can run the app for you, including sending them to the AI and speech services listed in our Privacy Policy when you use those features. That permission ends when you delete the content or your account. We don't use your content to train AI models, and we don't sell it.
7. AI features
Vivant's Chat, Scan, word explanations and pronunciation scores are produced by artificial intelligence. When you use them, you are interacting with an AI system, not a person. Moien Lux's "What did it hear?" feature is automatic speech recognition.
- AI can be wrong. Translations, explanations, example sentences and transcripts may contain mistakes.
- Pronunciation scores and transcripts are a guide to help you practise. They are not an assessment of your level.
- Don't rely on AI output for legal, medical, financial or other professional decisions, or for official documents.
8. Learning content and credits
The apps' design, code, word lists, phrases, notes and other content we created belong to VivantFlow LLC or the people who licensed them to us. You may use them for your own learning, but not copy or republish them without our permission.
- Moien Lux's native Luxembourgish recordings come from the Lëtzebuerger Online Dictionnaire (LOD.lu), Zenter fir d'Lëtzebuerger Sprooch, and are used with its permission.
- Vivant's audio is generated by a computer voice, not recorded by native speakers.
- Moien Lux is an independent practice tool. It is not made, endorsed or approved by the Institut national des langues Luxembourg (INLL), or by anyone who runs the Sproochentest, and using it is no guarantee of passing the test.
9. Paid features
Vivant and Moien Lux are currently free. If we introduce paid features, we will tell you the price and what you get before you pay, and update these terms first. In-app purchases on iPhone or Android are processed by Apple or Google, under their own terms, and refunds are handled by them. If you live in the EU or UK, you keep your statutory rights for digital purchases.
10. Suspending or closing accounts
You can stop using the apps at any time.
We may suspend or close a Vivant account if you seriously or repeatedly break these terms, if the law requires us to, or to protect other users or the service. Unless the law or a security risk prevents it, we will tell you why first and give you a chance to respond. If we close your account for any other reason, we'll give you at least 30 days' notice and a way to export your words.
11. Our responsibility to you
We build the apps with reasonable care and skill, and if you live in the EU or UK, they come with the legal guarantees your local law gives you for digital content and services. If something goes wrong because of us, tell us and we'll try to put it right.
Because the apps are free and run by a small team, we can't promise they will always be available or free of errors. We are not responsible for:
- losses that were not reasonably foreseeable when you started using the apps;
- business losses, such as lost profits or opportunities, since the apps are for personal use;
- problems caused by your device, your internet connection, or the app stores.
Nothing in these terms limits our liability where the law doesn't allow it to be limited, including for death or personal injury caused by our negligence, for fraud, or for harm we cause intentionally or through gross negligence. For users outside the EU and UK, and only as far as their local law allows, the apps are otherwise provided "as is", and our total liability for any claim is limited to US$100.
12. Other services
Some features depend on services run by other companies, such as AI and speech providers. We choose them carefully, but we don't control them, and an outage on their side may affect a feature for a while.
13. Apple App Store
If you got an app from Apple's App Store, these points also apply:
- These terms are between you and VivantFlow LLC, not Apple. We, not Apple, are responsible for the app and its content.
- You may use the app on Apple devices you own or control, as Apple's Usage Rules allow.
- Apple has no obligation to provide maintenance or support for the app. Please contact us instead.
- If the app fails to meet any applicable warranty, you can tell Apple, and Apple will refund any price you paid for it. Beyond that, Apple has no warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy, and claims that the app infringes someone's intellectual property.
- You confirm that you are not located in a country subject to a US government embargo, and are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and may enforce them against you.
If you got Vivant from Google Play, Google Play's terms also apply to your download.
14. Changes to these terms
We may update these terms when the apps change, or when the law or our service providers require it. If a change matters, we'll tell Vivant users by email or in the app at least 30 days before it takes effect, and post the new version here with a new date. If you don't agree with the change, you can stop using the apps and delete your account before it takes effect.
15. Law and disputes
These terms are governed by the laws of the State of Delaware, USA.
If you live in the EU or UK, you also keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts of that country. Nothing in these terms takes those rights away.
If you live elsewhere, disputes go to the state or federal courts in Delaware, unless your local law gives you the right to use your own courts.
If you have a problem, please write to support@vivantflow.com first. Most things can be sorted out quickly that way.
16. General
- If a court decides part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- You can't transfer your rights under these terms to someone else. We may transfer ours to a company that takes over the apps, provided your rights aren't reduced.
